INTRODUCTION

The course of International Civil Procedure is the part of the program for the professional education of specialists according to the educational and qualification degree «Master of Law» speciality 8.03020201 – «International Law». This course is the normative course and it is designed for Ukrainian and foreign students with at least a Bachelor of Law (or International Law) degree who are interested in gaining in-depth knowledge of transnational civil procedure.

The subject is lectured in the Ist semester of the Ist course and involves82 hours (2 ECTS credits), in particular: lectures – 34 hours, practical and seminar lessons – 34 hours, self-instruction work – 14 hours. The course provides for3content modules and 3 module work. The course ends with the exam.

Aim of the discipline is to give students systemic knowledge as well as practical professional skills necessary for participation in civil proceedings on private law matters that contain foreign element and fall under the jurisdiction of two or more states.

Objective of the discipline. The Course is intendedto provide students with knowledge on the main basic institutes of International Civil Procedure and with skills necessary for :work with multilateral and bilateral international agreements, internal legal acts of Ukraine in the field of civil proceedings with participation of foreigners, decision of practical legal questions, preparation of procedural documents, analysis and application of the rules of Private International Law and Civil Procedural Law.

Learning outcomes –

student should know:

- basic categories, principles and sources of Law of International Civil Procedure;

- rules of the main institutions of t Law of International Civil Procedure;

- tendencies and perspectives of International Civil Procedural Law development.

Student should have ability:

-to make system analysis of the rules of International Civil Procedural Law;

-to apply internal and international legal instruments in the field of International Civil Procedure;

- to draw procedural documents and to analyze procedural documents lodged by another participants of the proceeding.

Position of the Course in the system of professional education and its connections with other disciplines. The normative course of International Civil procedure is the part of the program for professional education of specialists according to the educational and qualification degree «Master of Law» speciality 8.03020201 – «International Law». Successful study of the course presupposes knowledge and skills received in the process of studying the courses of Comparative Civil Procedure, Private International Law and European Law.

Control of knowledge and disposition of the student’s rating. Contol is fulfilled according to the module-rating system. The I module includes topics 1-7, the II module includes topics 8-12 and the III module includes topics 13-16.

Results of student’s work are estimated according to the 100-mark system: 60 marks – during semester and 40 marks – during exam.

Rates according to the forms of control during semester:

- participation in the discussion (oral answer, addition) during practical or seminarlesson – up to 2

- module work – up to 10

- colloquium – up to 4

- presentation of short statement – up to 4

The quantity of marks corresponds to the following exam grade:

1-34 corresponds to the grade «poor», with the obligatory repeated study of the subject;

35-59corresponds to the grade «poor», with possibility to pass exam repeatedly;

60-74corresponds to the grade «satisfactory»;

75 - 84corresponds to the grade «good»;

85 - 90corresponds to the grade «good» («very good»);
